Scott Smith - Loudoun County Justice Served Via Pardon?
After the sexual assault of his 15 year old daughter justice is a long way from being served, as “everybody failed”
Loudoun County, Virginia - Earlier this year I had Scott Smith on my podcast, Maine Source Of Truth and we spoke about the horrific situation of his then 15 year old daughter being sexually assaulted in the bathroom of her school by a skirt wearing boy who had a history of warning flags leading up to this event. One of the absolute worst things a father could ever have to face. Virginia Governor Glenn Youngkin recently gave him an Absolute Pardon, clearing his name of any wrongdoing from his arrest at a school board meeting on June 22nd, 2021 while simply looking for answers.
After an altercation verbally defending his family from a far-left community member, Scott Smith was gang tackled by off-duty Loudoun County Sheriff Officers on June 22nd, 2021.
On this updated podcast, we talk through the details of all those who have done wrong in this situation and point out that regardless of political affiliation, there is a lot of blame to be shared. Nearly everyone that has touched this is guilty of something. It’s also tragic that not one party seems to really be looking out for the welfare and safety of the students…except Scott Smith the father who went to the floor in handcuffs for his daughter, seeking answers and now is seeking justice.

The Predator:
This boy who committed and was found guilty of two counts of forcible sodomy with sexual assaults in at least two Loudoun County Schools in May and October of 2021 at the age of 15 had red flags all over the place. School administrators chose to do nothing about it. Schools are looking to protect their image instead of being transparent with the parents and taxpayers. They often go further into the dark cave of secrecy rather than learn from past indiscretions to make sure they don’t ever happen again.
Reports stated this kid had a long history of sexual deviancy such as sending nude “dick pic” photos to a female classmate in the 5th grade. The school didn’t report these events to police and swept it under the rug, not placing this into the student’s disciplinary record. He was suspended six times in sixth and seventh grade for fighting, slapping a teacher and disrespect.
In 2021 it was stated he wore fishnet gloves, a “kitten” neck choker and skirts to potentially gain entrance to the female bathroom, just as the Loudoun County schools “8040 Rights of Transgender and Gender Expansive Students policy allows. All you have to do as a young man is pretend to be a girl, or be “gender fluid” or whatever and you get a free pass to the bathroom of your choice. These policies are in schools all over the United States. Maybe your local school?
There is some debate on him wanting prior access to the female bathroom in the report, but this is one of the most pressing issues at hand for parents and taxpayers inside these schools. This is where the trans-cult, the rainbow mafia, the LGBTQIA+/-$ has taken over and has placed your daughters at risk for potential sexual assault by creating policies that protect would be predators.
Creating a trans policy is like creating a policy for unicorns. Trans-students don’t exist. Boys and girls exist and there are an infinite amount of personalities, but when sexuality trumps safety, the world we are living in becomes a dark and evil place. This 8040 trans policy was being worked on by the school board at the same time they were made aware of the first sexual assault and it is this journalist’s opinion that rather than realize their error, they bowed down to the alter of the gender cult for political reasons. That school board could have prevented the second sexual assault.
This predator's own mother reported that her kid “feeds off any attention…negative and positive. And if he finds…another troubled kid…he [in certain circumstances] uses them as accomplices.” He was essentially an attention whore. A teacher even wrote a letter to school administrators stating that if this kid hurt someone, she didn’t want to be held responsible. It fell on deaf ears.
The predator told his mother that he was “pansexual,” which means that he allegedly has an emotional, or sexual attraction towards people regardless of sex, or gender identity. His mother claimed he was not transgender.
One Loudoun County School Administrator recalled his friend group as “...exploring LGBT kinds of things together, which is normal in high schools.” No, sexual narcissism and mental illness is not “normal” in high schools and teachers need to fully comprehend the reality of this statement. It is a social contagion, a nightmare being pushed into impressionable and often damaged minds by those running the schools. Students are celebrated for their introduction into the trans-cult. This is why we have seen a 4000% increase in alleged trans students.
The predator often used Discord on the school computer to chat with other students which is an “unmonitored environment” at the school. It is also noted that this predator used his school chromebook for viewing pornography. He was a horrible student overall, getting F’s in 3 classes and a D in another. Red flags and warning signs were everywhere. Part of me wants to feel sorry for him and his mother. A very small part.
On May 28th, 2021, he forcibly sexually assaulted Scott Smith’s daughter in the female bathroom of the Loudoun County Stone Bridge High School. She was 15 years old.
According to reports after the fact, the predator may have also had non-consensual sex with another Stone Bridge High School student prior to this situation, but it was not reported. When this kid turns 18, his name should be released to society before he hurts someone else again. Odds are high that he will do it again.
The Superintendent and the Loudoun County Public Schools (LCPS):
A Teaching Assistant (TA) inside the school reported after the fact that she saw “...two sets of feet in the same (bathroom) stall, but she did not hear any noise coming from the stall.” The TA immediately left the bathroom without saying anything and she did not report what she saw. This was the first step on the long road to the school’s abject failure. As a side note, many schools across the country are now installing floor to ceiling bathroom stalls, so you can’t see how many people are in them. They are often referred to as “rape and vape” stalls.
Loudoun County Superintendent Scott Ziegler and Stone Bridge High School administration knew of this sexual assault happening on May 28th, 2021. The victim went to the “main office” for a “good 30 to 50 minutes” to tell the nurse and assistant principal of LCPS what happened in the girls bathroom. Later that day, first the victim’s mother and then father, Scott Smith arrived at the main office. After exchanging some words, the Principal told Mr. Smith to “calm down.” That was the wrong response to an emotional father who had just learned of his daughter’s sexual assault taking place inside a school who failed to keep her safe.
That afternoon, the Principal documented the interaction in an email to his supervisors and Superintendent Scott Ziegler then sent the school board, his boss’ a “confidential email” in which he offered more concern about the verbal altercation with Scott Smith than the actual sexual assault of a student:

Superintendent Ziegler mentions that “services” will be provided for “students who witnessed the parent’s behavior.” No mention of services for the students now aware that a sexual assault had happened inside their school, nor the student that was taken in the bathroom. A sexual trauma had occurred. Yet, the lack of empathy and emotional intelligence by Mr. Ziegler is telling as to where school administrators are today. They want to protect their cabal at any and all costs.
The predator reported for school on Tuesday, June 1st, 2021 with his mother in tow. The Stone Bridge administration had not thought this sexual assault worthy of discipline, placing the predator on probation only. Previously suspended for “disrespect” he was now free to enter the school after “forcible sodomy.” The school administration simply thought that keeping the two parties separate during the day would be good enough. After the victim was pulled out of school by the Smiths, the LCPS made no attempts for outreach to the victim, nor her family to see how they were doing or to offer services, or support.
The LCPS didn’t follow their own threat assessment of the predator. If this was done, it could have prevented the Broad Run High School sexual assault with victim number 2. This additional sexual assault happened because LCPS just shuffled him off down the road to the next school so he could claim another victim. Just move the problem child along so someone else can deal with him. LCPS didn’t share many details with the Broad Run High School, where the predator was transferred, setting them up for imminent danger.
Superintendent Scott Ziegler, after being called out for his dysfunction, held a press briefing on September 15th, 2021 to state that “...this lack of oversight (with the Title IX process) that existed prior to my tenure also contributed to errors in our state reporting regarding disciplinary incidents in the school.” This had nothing to do with the current sexual assault that still was left undocumented by the school. It was an attempt to sidestep his responsibility for this crime.
Mr. Ziegler stated further, “The division inadvertently omitted some information in the past. That is extremely concerning and we are taking steps to ensure this process is improved.” There was no concern by Mr. Zieglar for the Smith family. He also stated during this charade when asked by a reporter that he was not willing to resign. He also lied about Title IX not being sufficient. Just pure evil.
Title IX Coordinator and Officer:
The Title IX Coordinator for LCPS was Mark Smith. Superintendent Scott Ziegler was also the Title IX Officer, basically the local school judge for Title IX issues. There was no mandatory reporting that took place as immediately necessary after the sexual assault and they didn’t take any steps to address the situation from the incident on May 28th, 2021 until nearly three months had passed.
On August 17th, 2021 the Director of School Administration (DSA) was made aware by the predator’s mother that the court had restricted him from returning to Stone Bridge High School and that the predator had been charged with crimes. But the mother wanted to “keep it private.” The DSA then asked, “Have either of you (Mark Smith and another Title IX Investigator) started a Title IX investigation?”
The DSA followed up with, “...we, by law, have to be involved earlier in the process.” There is no resolution, or response listed to this inquiry by the DSA.
The Stone Bridge High School Safety and Security Officer (SSO) emailed the Loudoun County Sheriff’s Office (LCSO) detective in charge and asked if the school could begin its administrative investigation. There appears to be no response, or follow up to this email either. There was no resolution until a follow up meeting on September 26th, 2021, now four months after the sexual assault and a mear two weeks before the second sexual assault occurred.
The Loudoun County Title IX Coordinator essentially buried the sexual assault over three to four months of inactivity and lack of mandatory reporting.
Virginia Department Of Education:
Dave Myers, PHD, Assistant Superintendent of Data, Research, Technology for the Virginia Department of Education emailed Ashley Ellis, LCPS Deputy Superintendent on October 14th, 2021, “We have seen recent news stories that there were criminal charges filed against a student at Stone Bridge High School last May for sexual assault against another student.” The problem here was that the LCPS’s had filed their mandatory reporting for Discipline, Crime and Violence (DCV) on August 13th, 2021 with no mention of this sexual assault incident.
Ashley Ellis’ October 20th, 2021 response almost a week later is weak at best. “...LCPS was not able to investigate this particular incident at the school level until October 2021.” Dave Myers states that the “reporting window is open through the summer…” Douglas Fulton, Ed. The Loudoun County Director of School Administration responds the same day with, “Do you want me to draft a letter?” Ashley Ellis says, “Yes please. Thanks!”
No concern in any of these emails for the victim and their family. Superintendent Scott Ziegler was cc'd on all this communication. Generally, a superintendent works a contracted 260 days a year, just like “normal” folks so the “it’s summer” excuse doesn’t hold water. This was a family's life hanging in the balance from clear errors made by the school.
The Loudoun County School Board (LCSB) and Board Of Supervisors:
The June 22nd, 2021 school board meeting was a setup from the beginning and we “tackled” that entire event the first time I had Scott Smith on Maine Source Of Truth podcast which if you want more backstory it is located here or anywhere you listen to podcasts.
To recap, the entire LCSB knew of this sexual assault on the day it happened via the “confidential” email sent by Superintendent Scott Ziegler. They all knew. None of them took action, they cowered like turtles in their shells, waiting for this to all somehow go away. To be someone else’s problem to deal with.
In Virginia school boards are required to adopt “policies for the establishment of threat assessment teams when it comes to sexual assaults. The LCSB woefully sidestepped their obligation to hold Superintendent Scott Ziegler, their employee, accountable. School boards exist for two reasons 1) to create policy and 2) to hold the superintendent accountable. Mr. Smith stated during the podcast, “They lied and…started a cover up.”
“Then…the pieces started falling apart so then they started all covering their butts,” says Scott Smith.
Instead of swiftly firing Superintendent Scott Ziegler after being made aware on December 31st, 2021 of the entire report on the sexual assault and his complete failure on his watch, the LCSB gave him a raise. No, seriously…they gave him a raise.
The Report Regarding Investigation into Misconduct at Stone Bridge High School and Broad Run High School by the lawyers of Blankenship & Keith P.C. document in detail the breakdown in this entire judicial process from start to finish. It unfortunately also breaks down the sexual assault in unnearving detail. There are also reports of the LCPS being guilty of dodging Freedom Of Information Act (FOIA) requests based on this entire case. Blame everywhere.
As reported by friend of the podcast Ian Prior, @iandprior on Twitter (X) who has broken this entire fiasco down stated that the LCPS independent report completed on December, 31st, 2021 stated that there were 159 “Google Docs” reports of Title IX violations since the beginning of the 2021/22 school year. “4 months, 159 reports, no investigations,” stated Mr. Prior. The report stated that in the eyes of the LCPS administrators, “None of the 159 reports have been determined to meet the threshold to open a Title IX investigation.”
LCPS School Board member Atoosa Reaser tried to blame the LCSO and attempted to insulate the LCPS officials stating they couldn’t act on the ongoing investigation because of the LCSO. Per Title IX schools may hold off on a pending investigation, but not required to. They are required to be mandatory reporters.
LCSB members, including Brenda Sheridan, Ian Serotkin, Jeff Morse, Atoosa Reaser, Erika Ogedegbe and Harris Mahedavi, voted against releasing the report earlier this year. Tiffany Polifko, John Beatty and Denise Corbo voted to release the report. Six against three, secrecy won…at that point.
What reasons did these six LCPS School Board members have to not release the report, detailing all of the issues of complete corruption in the process? Why would Harris Mahedavi and Erika Ogedegbe both run for reelection after their abject failure?
Erika Ogedegbe stated she voted against releasing the report “...in the interest of minor student privacy.” She was voted in last year to the board after campaigning on releasing the report but then at the last minute betrayed her constituents and voted no. Why would Atoosa Reaser think that based on her attempted cover-up, that she did such a good job she should now run for the House of Delegates? Frankly, why the entire school board didn’t resign, I don’t understand. Do these people have no shame?
To make matters worse, Loudoun County District Supervisor Juli Brinkman (she/her pronouns = sexual narcissist and LGBTQ cultist) said she didn’t think there is a systematic sexual assault issue in LCPS and stated this was “bullshit about the schools.” She also wanted to “Crush it” meaning to crush the report detailing the failures and that, “Hopefully they’ll learn their lesson.” Furthermore, as the Loudoun Times Mirror reported on February 14th, 2023, “...the letter (to release the LCPS report) was signed by all the supervisors except Supervisor Juli E. Briskman, (D)...”
The Grand Jury investigation found that LCPS didn’t have a proper Title IX process, so she couldn’t be more off base. This hotly contested race for Loudoun County Supervisors is also paramount to how these schools are administered and held accountable. Juli Brinkman is part of the problem, not part of the solution.
The Loudoun County Circuit Court granted the Virginia Attorney General, Jason Miyares’ request to unseal the LCPS official report on the two sexual assaults on September 14th, 2023. More than a year and a half after it was completed on December 31st, 2021. More than two years after all the LCSB members knew of the sexual assault occuring on May 28th, 2021.
Superintendent Scott Ziegler was ultimately fired on December 6th, 2022 after the school board needed someone to pin this fiasco on. I don’t disagree with their actions, but they should have fired themselves in the process. No other LCPS employee has been fired to date. As a side note, because the LCSB failed to fire Scott Ziegler “with cause” he will be paid his $323,000 annual salary for the next year, including health insurance and retirement benefits. He’s still being paid as you read this article. The guy should be behind bars.
Loudoun County Sheriff’s Office (LCSO):
Loudoun County off duty Sheriff Deputies who were hired by the school district in full uniform, displaying their badges with “Sheriff” patches on the backs of their bullet proof vests, including the Lieutenant of Sheriff Mike Chapman (R) were present that evening of the June 22nd, 2021 school board meeting. They tackled Scott Smith to the ground, pulling off his pants in the struggle and handcuffed him. He was thrown into the paddy wagon and hauled off to jail. It was a bad look for the LCSO. The left-wing media then without knowing the rest of the story attacked Mr. Smith for “fighting” at the school board meeting. The far-left crazies came after him and his entire family.
The report indicates that the LCSO threatened to arrest the Director of School Administration for advancing the investigation of the sexual assault while the LCSO was investigating the same incident which involved potential criminal charges. They stated that “any staff who investigated the allegations could be arrested.” Mr. Smith during the podcast stated that “He (Sheriff Chapman) refused to work with the school…He basically told his people, his deputies, to not cooperate with the school (investigation).”
“Nobody would communicate with anybody because everybody was so egotistical that they refused to work with one other,” says Scott Smith.
Sheriff Chapman has yet to make a comment to the press about the pardon and has not yet apologized to Scott Smith and his family for the abuse caused by his officers, his own accountability, nor empathized with their trauma. Zero communication to the Smith family, not even an explanation of what happened.
Jon Tigges, friend of the podcast stated, “Mike Chapman forcefully assured me that he believes he’s above the Constitution of the United States.” Sheriff Chapman is seeking reelection in November.
The Judge and the Courts:
On July 8th, 2021 ten days after the incident, the court issued a petition for the predator’s arrest and a detention order. The predator surrendered himself to the LCSO the same day. The court released the predator on July 27th, 2021, with a provision that he did not return to Stone Bridge High School. He was shuffled down the road to Broad Run High School.
The teenager convicted of two assaults at separate high schools in Loudoun County, Virginia will not have to register as a sex offender for life after a juvenile court judge had to reconsider her initial ruling, as reported by WTOP news. “Instead, the now-15-year-old who was found guilty of two counts of sodomy in a May 28 (2021) incident at Stone Bridge High School and a separate incident on Oct. 6 (2021) at Broad Run High School will remain on supervised probation in a locked juvenile treatment facility until his 18th birthday.” Hardly seems like enough of a penalty, given the three sexual assaults as noted in court.
During Scott Smith’s ongoing legal battle, he had a substitute judge from the bench say, “Not only did he deserve to be arrested, but he also deserved to be slapped.” America’s two-tiered legal system in action.
The Virginia Commonwealth Attorney:
Scott Smith was improperly charged with Obstruction of Justice and Disorderly Conduct, two trumped up, bogus charges by the office of the Virginia Commonwealth’s Attorney for Loudoun County, Buta Biberaj. Instead of resigning over this travesty of justice, she is also running for reelection in November.
Buta Biberaj, or as Ian Prior calls her, “Box Wine Buta,” who is a George Soros funded, far-left radical, is losing her mind over the fact that her prized “domestic terrorist,” her trophy mount on her office wall has been rightfully pardoned for a situation that never should have occurred in the first place.

It is unclear if she was drunk tweeting from her @ButaBiberaj account on Twitter (X) as she has tweeted several times on this subject whining that the “pardon should not be allowed.” Some of these tweets sent at 1am in the morning! It is obvious that Scott Smith lives rent free in her tiny little brain. If she had done her job, worked through the investigation properly, the sexual assault of another family in Loudoun County would never have occurred. But instead, she’s being soft on the problem and soft on the criminals. Typical democrat.
Furthermore it is reported that Buta Biberaj threw the initial prosecutor off the predator court case and may have purposely “botched” the paperwork that would have led to the predator being on the adult sex offender list for life. She also may have tried to hide one of these court hearings, so the Smith family was not aware of its proceedings.
Ms. Biberaj has lost all sight of the reason she serves the taxpayers, which is to serve justice. To put actual criminals in jail for actual crimes. She’s a fraud and a failure and it is unclear why any Loudoun County taxpayer in their right mind would vote for this horrible excuse for a lawyer. Early voting starts September 22nd, so voters need to take heed in their choice.
The Governor:
Virginia Governor Glenn Youngkin provided Scott Smith an Absolute Pardon on September 8th, 2023 for the Obstruction of Justice and Disorderly Conduct crimes he faced in an imminent court case with mounting legal expenses. An Absolute Pardon is described as releasing the “wrongdoer” from punishment and restores their civil rights without qualification. It essentially wipes the slate clean.

This is where justice initially prevails, but it wasn’t without cost and it took over two years to come to fruition. It may not have happened without Mr. Smith stating he was very frustrated by the broken justice system, lack of contact and lack of early action by the Governor. Until this time, Scott Smith had never spoken directly with the Governor.
Governor Youngkin stated, “We righted a wrong. He should have never been prosecuted…this was a dad standing up for his daughter...his daughter had been sexually assaulted in the bathroom of a school and no one was doing anything about it.”
Governor Glenn Youngkin is a bit handcuffed given that the democrats control the Virginia Senate, but Governor Youngkin could be much more influential and hard hitting on the subject of gaining Virginia parents and taxpayers educational freedom. This is where the tax money follows the student, instead of the property taxes going to your local brick building. He has worked on some good things, but I believe could be pushing harder to reach the parents of Virginia and our nation.
From all accounts, Jason Miyares, Attorney General of Virginia has been very empathetic to the Smith family and their desire for justice. But, the timing of all of this feels somewhat politically motivated and I’d hate that to be the case when lives are impacted by tragedy.
We hope that Governor Youngkin sees this as another opportunity to distance conservatives from the far-left who are continuing to push a failing educational model through the radical teachers unions and hemorrhaging departments of education. I believe Governor Youngkin needs to select a number of parents in Virginia to join forces with his office and hammer out a model for educational freedom and if the democrats in the senate don’t vote for it, use that as leverage in the next election!
US Department Of Justice:
Scott Smith became the face of US Attorney General Merrick Garland’s now infamous “domestic terrorism” letter crafted in part by the National School Board Association (NSBA). The preceding emails from the NSBA to the Department Of Justice named Scott Smith as a “threat” and that later was pushed through to the FBI letter. They did this to scare Americans and speaking from personal experience, this FBI letter made me make some legal decisions I never would have, if not for this letter hanging over my head. They wanted to squash the First Amendment and those concerned parents speaking up at school board meetings. Something I will continue to be very vocal with, given my three active lawsuits involving free speech with two local Maine school districts.
School board meetings in some places like Loudoun County gathered nearly 500 people at the height of these concerns with Critical Race Theory, Covid political theater, the hyper-sexualization of minors. Now, those same areas might see a dozen or so parents attending. Don’t lose sight that your liberties are at risk. If you give up, they win and you will lose.
Merrick Garland was on the hot seat yesterday on Capitol Hill testifying in front of the House Judiciary Committee about a “weaponized Department Of Justice.” AG Garland did not offer an opinion about the pardoning of Mr. Smith yesterday, claiming he “...didn’t know the facts in the case.” I find that very hard to believe. The fact remains, the memo was never rescinded by AG Garland. The NSBA has since apologized, yet no apology has come from the DOJ and AG Garland of the implication that Scott Smith was a domestic terrorist. Parents across the country are owed an apology.
AG Garland was asked yesterday by United States Representative Chip Roy - Texas (R) about the Scott Smith case. AG Garland responded with only knowing about it “in the extent that I’ve read in the press.” His non-answers were crystal clear. He knew all along, including an exchange from Representative Jim Jordan to Merrick Garland on October 27th, 2021 at the Judiciary Oversight Hearing, asking him if he discussed the memo with the White House before the FBI memo was sent.
Merrick Garland then stated, “But the White House is perfectly appropriately concerned about violence (at school board meetings). I’m not aware of any actual violent acts at any school board meetings across the country in the three plus years I’ve been involved in this. The question from Rep. Jordan about the American Federation of Teachers and the National Education Association (both teachers unions) and the National School Boards Association remains unanswered by AG Garland, but it seems pretty obvious that there was heavy influence in the memo to the FBI.
AG Garland has weaponized the DOJ against conservatives and we are living in a two-tiered system of justice. If you are a far-left radical looking to destroy the country, you are given a pass. If you are a conservative, or a Christian you are held accountable to the full extent of the law and in some cases, they make the law up as they sentence you.
The President of the United States:
Joe Biden, Barack Obama, Hillary Clinton, or whomever is running the White House is responsible for all this at the top. The buck stops with them. Identity politics is being used to indoctrinate the weak, enable the mentally confused and seduce the sexually deviant inside our K-12 public schools. Their goal is to divide the family, divide the country and destroy it from within by ruining our next generation of Americans. It’s pure communism unfolding before our very eyes.
President Joe Biden thinks that our K-12 public school students are their children. Not yours. They are children of the state. There should be no co-parenting with the government, ever.
Without massive change in our legislative leadership and at the top with the President, more families will suffer at the hands of the guilty and the weaponized department of justice. We are living in a banana republic, instead of a Constitutional Republic. Your vote and elections have consequences.
The Parents of Loudoun County:
The Smith family has suffered greatly and continue to pick up the pieces of their lives, shattered by all guilty parties involved. “We’ve spent a ton of money…defending this and…at the end of the day it was a stupid misdemeanor, it wasn’t a big deal, but it was a big deal, because I wasn’t just fighting for me, but I was fighting for everybody” says Smith.
Money won’t reclaim the loss of their emotional heartbreak, but I for one hope the Smith family takes that school system’s insurance company for millions and that some of these involved see prison sentences given these clear Title IX violations. I hope they can get away and rebuild their lives together as a family.
Victim number 2 has already settled their case.
Ultimately, the parents of Loudoun County and parents across the United States are suffering because of the woeful K-12 public education system. The worst academic assessments of our history with the highest tax burden in our history. A negative return on investment. We’ve allowed this to happen and now we are playing catch up from the last number of decades.
Until more parents are exposed to these horrors and push for educational freedom and immediately pull their children out of these schools, each day they risk something like what happened to the Smith family happening to them. Schools as we have seen, will hide it from you.
