Maine Journalist Fights Back After School Department Threatens to Sue Over His Article Exposing Trans Bathroom Policy Controversy
Hampden, Maine - Shawn McBreairty, a journalist and educational advocate, in conjunction with the Center for American Liberty and Randazza Legal Group, filed a lawsuit against the Brewer School Department, Superintendent Gregg Palmer, Principal Brent Slowikowski, and English Teacher Michelle MacDonald, for violating McBreairty’s First Amendment rights by forcing him to take down an article criticizing the school department’s controversial bathroom policy.

“This case is about our basic freedoms. No government entity has the right to shut down journalism on matters of public concern. But that is what happened here. We trust that the Federal Court will uphold our freedoms, not just for Mr. McBreairty, but for everyone,” Marc Randazza, Managing Partner of Randazza Legal Group, said.
Background:
McBreairty published an article regarding a group of students who circulated a petition about a new bathroom policy implemented by the Brewer School Department. The bathroom policy allows students to use the bathroom corresponding to their gender identity, which sparked concerns among students regarding safety and privacy. Those students circulated a petition (see below) to voice their views but were told by school officials this action could be a “hate crime”.
McBreairty's article entitled “Girl’s Bathrooms are Not ‘Safe Spaces’ When Males are Present” highlighted these concerns and reported on the petition. However, after the publication, school officials threatened McBreairty with legal action if he did not remove the article, citing the violation of school policies and resultant distress to certain school district employees mentioned in the article.
The lawsuit argues that the actions of the Brewer School Department and its officials constitute a violation of McBreairty’s First Amendment rights to freedom of speech and expression, as well as his right to petition the government.
McBreairty seeks declaratory and injunctive relief, as well as damages for the infringement of his constitutional rights. The lawsuit also demands a jury trial to adjudicate the claims.
